E-Commerce Terms of Use.

  • Article 1 (Purpose)

    The purpose of the General Terms and Conditions is to define the rights, obligations and responsibilities of KidZania Seoul Cyber Mall (hereinafter referred to as "Mall") and users in using the internet related service (hereinafter referred to as the "service") that is provided by Mall that is operated by MBC Playbe Co., Ltd. (e-commerce business).
  • Article 2 (Definitions)

    1. ① Mall means the virtual business premises set to transact for goods and others by using the information communication facilities, such as, computer and others, in order to provide the users with the monetary goods or service (hereinafter referred to as "goods and others") by MBC Playbe Co., Ltd., and it is used for the meaning of business that operates the cyber mall.
    2. ② "User" means the member of 14 years or older having the service provided by Mall in accordance with the General Terms and Conditions by linking to Mall.
    3. ③ 'Member' is a person with the membership registration by providing personal information to Mall that it is continuously provided with the information of Mall and keep using the service provided by Mall.
    4. ④ 'Non-member' means the person that uses the service that Mall provided without subscribing to the membership.
  • Article 3 (Specification, Description and Revision of General Terms and Conditions and Etc.)

    1. ① Mall shall post the contents of the General Terms and Conditions, trade name, representative name, business office address (including the address at the place to process the consumer discontent), TEL, FAX, e-mail address, business registration number, mail order report number, responsible person of personal information management and others to enable users to easily find out by posting them on the initial service screen (front). However, the contents of the General Terms and Conditions shall be made for users to see through the linked screen.
    2. ② From the contents set forth under the General Terms and Conditions, Mall shall provide separate linkage screen or pop-up screen for user to understand important contents, such as, subscription withdrawal, refund requirement and others before users agreeing to the General Terms and Conditions to seek for the user confirmation.
    3. ③ Mall may revise the General Terms and Conditions within the scope not to violate any pertinent laws and regulations, such as, the Act on Consumer Protection on E-Commerce and Etc, the Act related to the provisions of the General Terms and Conditions, the Framework Act on E-Commerce, the Electronic Signature Act, the Act on Promotion on Service of Information Communication Network and Information Protection, the Act on Door-to-Door Sales, the Consumer Protection Act and others.
    4. ④ In the event that Mall revises the General Terms and Conditions, the date of application and cause of revision are specified to notify up to the previous date of application at least 7 days prior to the application date on the initial screen of Mall together with the current General Terms and Conditions. However, in the event that the contents of the General Terms and Conditions are modified adversely to users, it shall be notified with the reserve period for 30 days or more. In this case Mall shall clearly compare the contents before revision and after revision and mark as easy to know by user.
    5. ⑤ In the event that Mall is to revise the General Terms and Conditions, the revised General Terms and Conditions shall be applied only on the Agreement entered after the application date and, with respect to the already consummated Agreement, the provisions of the General Terms and Conditions prior to the revision shall be applied. However, the provisions of the revised General Terms and Conditions are applied in the event that the user already entered into the Agreement conveys its intent to have the application of the revised General Terms and Conditions to Mall within the notice period of the revised General Terms and Conditions under Paragraph 3 and obtained the consent of Mall.
    6. ⑥ With respect to the matters not set forth under the General Terms and Conditions and interpretation of the General Terms and Conditions, it shall follow the Act on Consumer Protection on E-Commerce and Etc, the Act on Regulation of the General Terms and Conditions, consumer protection instruction under e-commerce set forth by Fair Trade Commission, pertinent laws and regulations or commercial practice.
  • Article 4 (Provision and Modification of Service)

    1. ① Mall shall carry out the following affairs.
      1. 1. Provision of information on goods and others or service and entering into the purchase contract
      2. 2. Forwarding of goods or service with purchase contract
      3. 3. Other works set forth by Mall
    2. ② In the event that there is discontinuous of goods or service or modification of technical spec, Mall may modify the contents of goods or service to be provided under the Agreement to be entered in later time. In this case, the contents and provision date of modified goods or service shall be specified to notify immediately to the place where the contents of present goods or service are placed.
    3. ③ In the event that the contents of service entered by Mall to provide with user is modified due to the cause of modification of quality for goods and others and technical specification, the cause shall be notified immediately to the address to user.
    4. ④ In the event of the previous Paragraph, Mall shall make the damage compensation of user. However, it shall not be the case in the event that Mall proves that it is not at intentional or negligent.
  • Article 5 (Suspension of Service)

    1. ① In the event that there is any cause of maintenance, replacement, break-down, disconnection of communication of IC facilities, such as, computer and others, Mall may temporarily suspend the provision of service.
    2. ② Mall shall make damage compensation for user or third party from temporary suspension of service provision under Paragraph 1. However, it shall not be the case in the event that Mall proves that it is not at intentional or negligent fault.
    3. ③ In the event that the service is not to be provided due to the conversion of business category, giving up the business, integration of businesses and others, Mall shall notify users with the method set forth under Article 8 and compensate consumers in accordance with the requirement presented by Mall. However, in the event that Mall does not notify the compensation standard and others, it shall pay users with goods or cash equivalent to the currency value used in Mall for mileage or reserve of users.
  • Article 6 (Subscription of Membership)

    1. ① User shall apply for membership subscription by indicating its intent to agree to the General Terms and Conditions after filling in the member information in accordance with the subscription form provided by Mall.
    2. ② "Mall shall register user that applied for subscription as member under Paragraph 1 as its member unless otherwise applicable for the followings.
      1. 1. In the event that the applicant for subscription has lost the membership qualification before under Article 7 (3) of the General Terms and Conditions; however, it shall be an exception in the event that the person lapsing 3 years after the loss of member qualification by Article 7 (3) and obtained for approval of re-subscription of membership of Mall.
      2. 2. In the event that the contents of registration have false, omission or error
      3. 3. In the event that the registration as a member has clear interference on technology of Mall
    3. ③ The establishment time of the membership subscription contract shall be the time to reach the consent of Mall to member
    4. ④ In the event that there is any modification on the registration matter under Article 15 (1), the member shall inform the modification on Mall via e-mail or other method.
  • Article 7 (Withdrawal from Membership, Disqualification and Etc.)

    1. ① A member may request for withdrawal to Mall at anytime and Mall shall process the membership withdrawal immediately.
    2. ② In the event that a member is applicable to any of the followings, Mall may restrict and suspend the member qualification.
      1. 1. In the event that the false contents are registered at the time of applying for subscription;
      2. 2. In the event that the payment is not made on the due date for members in relations to the proceeds for goods and other Mall use by making the purchase by using Mall;
      3. 3. In the event that it threatens the e-commerce order by interfering other persons for Mall use and misuse the information; or
      4. 4. In the event that Mall is used to undertake the act against the social norm or prohibit by laws and regulations or General Terms and Conditions.
    3. ③ After Mall restricts or suspends the member qualification, in the event that the same act is repeated twice or more or not remedy the action within 30 days, Mall may disqualify the membership.
    4. ④ In the event that Mall disqualifies the member qualification, the membership registration shall be cancelled. In this case, notice shall be given to members and grant an opportunity to clarify by setting forth a term of a minimum of 30 days before cancelling the membership registration.
  • Article 8 (Notice on Members)

    1. ① In the event that Mall notifies on members, it may stipulate with member to forward to its stipulated e-mail address.
    2. ② In the event that the notice is made to all unspecified members, Mall may substitute individual notice by posting on the bulletin board of Mall for a week or longer. However, individual notice shall be made on matters for material influence in relation to the transaction of the member.
  • Article 9 (Purchase Application)

    Any Mall user may apply for purchase under the following or similar method and Mall shall provide following contents easily find out by users in its application for purchase. However, in the event of the member, the application of Section 2 through Section 4 may be excluded.

    1. 1. Search and selection of goods and others
    2. 2. Input of name, address, TEL, e-mail address (or mobile phone number) and others
    3. 3. Confirmation on contents related to General Terms and Conditions, service restricted for subscription withdrawal right, delivery expense and other burden on expenses
    4. 4. Indication to confirm or refusal of matters under Section 3 and agree to the General Terms and Conditions (for example, clicking of the mouth)
    5. 5. Consent on purchase application of goods and others, confirmation thereof or confirmation of Mall
    6. 6. Selection of payment method
  • Article 10 (Establishment of the Agreement)

    1. ① Mall may not consent if the application for purchase is made under Article 9 which is applicable to followings. However, it has to notify the contents that, in the event that the Agreement is consummated with a minor, and if the consent of the legal representative is not obtained, the Agreement may be cancelled by the minor or the legal representative.
      1. 1. In the event that there is any false information, omission of information or error in the contents of application;
      2. 2. In the event that a minor purchases goods and service that is barred by the Youth Protection Act, such as, cigarettes, alcohol and others; or
      3. 3. In the event that consenting to the purchase application is determined as having clear interference on the technology of Mall
    2. ② When consent of Mall is reached to users in reception confirming notice type under Article 12 (1), the contract is considered as consummated.
    3. ③ In the indication mark of Mall's consent, it shall include confirmation on user's application for purchase, availability for sales, revision or cancellation of application for purchase and other relevant information.
  • Article 11 (Payment Method)

    The proceeds payment method on goods or service that is purchased from Mall may be made by any of the following methods. However, Mall shall not be entitled to collect any fee at all after notice to users on the proceeds of goods and others in accordance with needs for the payment method of users.

    1. 1. Various account transfers of phone banking, internet banking, mail banking and others
    2. 2. Pre-payment card, direct payment card, credit card and other various card payments
    3. 3. Online transfer deposit
    4. 4. Payment by the electronic currency
    5. 5. Payment by gift certificate with the contracting with Mall or recognized by Mall
    6. 6. Other proceeds payment and others under online payment method
  • Article 12 (Modification and Cancellation of Reception Confirmation Notice and Purchase Application)

    1. ① Mall shall make the reception notice to user in the event that there is application for purchase by user.
    2. ② In the event that there is inconsistency of intention, user with the reception confirmation notice may request for modification and cancellation of purchase application after receiving the reception confirmation notice and Mall shall process it in accordance with the request without delay in the event that there is a request of user. However, in the event that the proceeds are paid in advance, it shall follow the provision of Article 15 for subscription withdrawal and others.
  • Article 13 (Supply of Goods and Etc.)

    1. ① Unless there is any separate stipulation on the supply period of goods and others with user, Mall shall take necessary measure for order production, package and others to forward the goods and others within 7 days of making the subscription by user. However, in the event that Mall has received all or part of goods and others in advance, action shall be taken within 3 business days from receiving all or part of proceeds. At this time, Mall shall take appropriate action to confirm the supply procedure and status for user of goods and others.
    2. ② Mall shall specify on goods purchased by user for each delivery method, payment of delivery expense, delivery period for each mean and others. In the event that Mall exceeded the stipulated delivery period, it shall make the damage compensation for users. However, in the event that Mall proves that it is not intentional or negligent act, it shall not be the case.
  • Article 14 (Refund)

    When user is unable to deliver or provide goods and others that user applied for purchase due to the non-availability, Mall shall notify the cause to user without delay, and in the event that the proceeds of goods and others are not received, it shall refund or take necessary measures for refund within 3 business days from the date of receiving the proceeds.

  • Article 15 (Withdrawal of Subscription and Etc.)

    1. ① Any user that enters into the contract on purchase for goods and others with Mall may withdrawal the subscription within 7 days from the date of receiving the reception notice.
    2. ② In the event that it receives the delivery of goods and others, user shall not refund and replace in the event that it is applicable to any of the followings.
      1. 1. In the event that goods and others are damaged or lost with the responsible cause to user (However, in the event that the package is damaged to confirm the contents of goods and others, the subscription withdrawal may be available);
      2. 2. In the event that the goods or other value is clearly decreased by the use of user or partial consumption;
      3. 3. In the event that the goods or other value is clearly decreased due to the lapse of time with the re-sale not possible; or
      4. 4. In the event that the packing of goods and others is damaged in the event that reproduction is possible with the goods and others with same capability
    3. ③ In the event of Section 2 through Section 4 of Paragraph 2, the subscription withdrawal of user is not to be restricted if there is no action taken for providing the product or specifying it to the place for easy knowledge for consumers with the restriction for subscription withdrawal in advance
    4. ④ Notwithstanding the provisions of Paragraph 1 and Paragraph 2, and in the event that the contents of goods and others is different from the contents of indication and advertisement or performed differently from the contents of the Agreement, the subscription withdrawal and others may be made within 3 months from the date of supplied for applicable goods and others and 30 days from the date of knowing the fact or should have known.
  • Article 16 (Effect of Subscription Withdrawal and Etc)

    1. ① In the event that it is returned of goods and others from user, Mall shall refund the proceeds for goods and others already paid within 3 business days. In this case, when Mall delays the refund of goods and others to user, the delay interest shall be paid with the calculation by multiplying the delay interest rate set forth and notified by Fair Trade Commission on the delay period.
    2. ② When the proceeds of goods and others are paid by the payment method of credit card, e-currency and others by users with refund of the above proceeds, Mall shall request for suspension or cancellation for proceeds of goods and others from the business that provided the applicable payment method without delay.
    3. ③ In the event of the subscription withdrawal and others, any expense that is required for returning of goods and others shall be paid by user. Mall shall not claim for penalty or damage compensation due to the withdrawal of subscription and others to users. However, expenses required to indicate the contents of money and others. In the event that user pays the forwarding expense when provided for goods and others, Mall shall clearly indicate who pays the expense at the time of subscription withdrawal for users to easily know.
  • Article 17 (Protection of personal information)

    1. ① Mall shall collect minimal information required for the purchase contract performance when it collects user information. Following matters are required while other matters are selectively made.
      1. 1. Name
      2. 2. Address
      3. 3. TEL
      4. 4. Desired ID (in the event of member)
      5. 5. Password (in the event of member)
      6. 6. E-mail address (or mobile phone no.)
    2. ② When Mall collects personal information available for personal identification of user; it shall obtain the consent of the applicable user.
    3. ③ The provided personal information shall not be provided to a third party or used for any other purpose without the consent of the applicable user and all responsibilities thereto shall be on Mall. However, it shall be excluded in the following case.
      1. 1. In the event that it informs the minimal information of user (name, address, and TEL) required for the delivery to the delivery company for the delivery work;
      2. 2. In the event that it is required for statistics, academic research or market survey that is provided in the type not to identify specific individual;
      3. 3. In the event that it is required for proceeds settlement following the transaction for goods and others;
      4. 4. In the event that it is required for personal identification for preventing theft; or
      5. 5. In the event that there is any laws and regulations or inevitable cause required by laws and regulations
    4. ④ In the event that Mall is required to obtain the consent of user under Paragraph 2 and 3, the matters defined under Article 22 (2) of the Act on Promotion on Service of Information Communication Network and Information Protection, such as, identity (position, name and TEL, other contact) of responsible person of personal information management, purpose of collecting information, and purpose of use, matters related to information provision on third party (person provided, purpose of provision, contents of information to be provided) shall be specified or notified in advance and user may withdraw this consent at anytime.
    5. ⑤ User may request to open and correct the error in its personal information that Mall has at any time and Mall shall have the obligation to take action without delay. In the event that user requests to correct the error, Mall shall not use the applicable personal information until the error is corrected.
    6. ⑥ Mall shall limit the manager to minimize the number for personal information protection and shall bear all responsibilities on losses of user from loss, stealing, disclose, alteration and others of user personal information including credit card, bank account and others.
    7. ⑦ Mall or a third party provided the personal information from Mall shall destroy the applicable personal information without delay when the purpose of collection or provision of personal information is accomplished.
  • Article 18 (Obligations of Mall)

    1. ① Mall shall not undertake any act that is barred by laws and regulations and the General Terms and Conditions or against the public norm and do its best to provide continuous and stable goods and others in accordance with the matters set forth under the General Terms and Conditions.
    2. ② Mall shall be equipped with the security system for the protection of personal information (including credit information) of user in order for user to safety use the internet service.
    3. ③ When inflicting the loss by user by certain unjust indication or advertisement action under Article 3 of the Act on Standardization of Indicated Advertisement with respect to the product or service, Mall shall have the responsibility to compensate such loss.
    4. ④ Mall shall not forward any profit-based advertisement e-mail not desired by user.
  • Article 19 (Obligation on ID and Password of Members)

    1. ① The responsibility to manage ID and password other than the case of Article 17 shall be on member.
    2. ② The member shall not cause a third party to use its ID and password.
    3. ③ In the event that a member recognizes its ID and password stolen or has a third party using it, it shall notify Mall the fact and follow in the event that Mall instructs it to do so.
  • Article 20 (Obligations of User)

    Any user shall refrain from following acts.
    1. 1. Registration of false contents at the time of application or modification
    2. 2. Misuse of someone else's information
    3. 3. Modification of information posted on Mall
    4. 4. Transmitting or posting of information other than information set forth by Mall (computer program and others)
    5. 5. . Interference on intellectual property rights, such as, copyright of Mall or third party
    6. 6. Any act that damages the honor or interferes with work of Mall or other third party
    7. 7. Any act to disclose or post information on lewd or violent message, screen, voice or other social norm
  • Article 21 (Relationship between Linked Mall and Non-Linked Mall)

    1. ① In the event that the upper Mall and lower Mall are linked with the hyper-link (for example: subjects of hyper-link are included in text, diagram, moving picture and others) method and others, the former is linked "Mall" (web-site) and the later is non-linked "Mall" (web-site).
    2. ② The linked "Mall" shall not have the guaranteed responsibility on its transaction in the event that the non-linked "Mall" is specified on the pop-up screen of the time to link or initial screen of linked "Mall" with the intent of not taking the guarantee responsibility on transactions undertaken with user by goods and others to independently provide.
  • Article 22 (Reversion of Copyright and Restriction of Service)

    1. ① The copyright and other intellectual property rights on the production made by Mall shall be reverted to Mall.
    2. ② From the information obtained by using Mall, user shall not use for profit purpose or enable third party to use the information reverted with the intellectual property rights under reproduction, transmission, publication, distribution, broadcasting and other methods without advance consent of Mall.
    3. ③ In the event that the copyright reverted to user in accordance with the stipulation is to be used, Mall shall notify the same to applicable user.
  • Article 23 (Dispute Resolution)

    1. ① Mall shall reflect justifiable opinion or discontent by user and establish and operate damage compensation body in order to compensate the damage.
    2. ② Mall shall take care of the situations of discontent or opinion from user with the priority. However, in the event that the prompt processing is difficult, the cause and processing schedule are notified to users immediately.
    3. ③In the event that there is a relief petition of user in relation to the dispute on e-commerce arising between Mall and user, it may follow the reconciliation of Fair Trade Commission or dispute reconciliation institution that mayor and governor requested.
  • Article 24 (Right to Adjudication and Applicable Law)

    1. ① Any litigation on the e-commerce dispute arising between Mall and user shall be made at the address of user at the time of bringing the suit, and in the event that there is no address, the district court having the jurisdiction over the resident shall be the court of exclusive jurisdiction. However, at the time of litigation, in the event that the address or residence of user is not clear or for foreign residents, it is brought into the court of jurisdiction under the Civil Procedure Act.
    2. ② Korean laws shall be applied for any e-commerce litigation raised between Mall and user.
